Verdict of $250 Awarded in $5000 suit for damages: Judgment of $250 and costs was yesterday awarded Halvin Benson against Homer R. Cotterman, former Carroll school teacher and now instructor at Capital University, by verdict of the jury in trial of a $5000 suit for damages in common pleas court. Benson sought the $5000 for damage to his reputation which he claimed had been suffered by a statement attributed to Cotterman, according to the petition. Benson charged Cotterman with saying "I had $12 worth of stuff taken off my automobile and you are the guilty party; you might as well acknowledge it and pay for it". The suit was instituted in 1924 and continued a number of times since then. Benson was represented by attorney J. H. [F?]ultz, and Cotterman by Silbaugh and Silbaugh. OBIT:

Daniel was killed in saw mill explosion with
son William as described
in the Miami Sentinal of 4 Aug 1859:

Boiler Exploded---Three Men Killed

A most afflictive casualty occurred in Union township, in this county,
on Monday, 25th ult. While Daniel Hart, his son William and John Hipple,
were occupied with in the the Steam Saw Mill of the former, the boiler
exploded, demolishing the building and almost burying the occupants in the
ruins. A large heated iron shaft fell upon the breast of Hipple, literally
crushing his body, and leaving its parched imprint upon his flesh. He
neither moved nor spoke, but breathed heavily for some hours and died.

William's thigh was muched, from the body to the knee, and his elbow was
dislocated. He died the next day.

Daniel Hart was found at the mouth of the furnace, embedded in hot
castings and brick. He was much bruised and died on the following Monday.

The multitude that attended his funeral on Tuesday, attest the esteem in
which he was held by his neighbors. Mr. Hart retained the use of his senses
to the last moment of his life, having made his will in the mean time.

They all leave wives and children to lament their untimely fate.

Dr. Banks, of Fulton county, and one Jacob Uhee, were in the mill at the
time of the accident, but had, just a moment previous to the explosion,
stepped into an adjoining room, and thus, perhaps, escaped a similar fate.

The unfortunate men were aware of the danger, and in endeavoring to avert
the dreadful catastrophe, lost their lives.

Dates in the above news reports do not correlate to death dates reported on tombstone markers. William's stone documents date of death as 21 July 1859, not the 26th as indicated from the text of the news article.

[9758] NAME: "Partition Record Abstracts, V1, 1812-1851 Fairfield County, Ohio", Fairfield County Chapter OGS, 1987, p 21. Case #196 is the estate of Wlkeson LANE of Bloom Twp. Will written November 9, 1813 and filed in 1814 in Will Book 2, page 20. He owned land in section 33, twp 14, range 20. Heirs were wife Jane, son John, daughters Elizabeth, Rebeckah and Mary, plus grandsons James and Elisha Cole, and children of his daughter Rebecca (RACHEL??) Barr who were Wilkinson and Nancy Barr. Administrators were sons-in-law Horatio Clark and James Kelley.

DOB/POB: From info submitted to ancestry.com by Leah Heiden, August 2001.

"... Wilkinson Lane... in 1799 was accompanied by the families of his son, John Corbin Lane, and sons-in-laws James Kelly and Horatio Clark, Sr. It is quite likely that Clark, and possibly James Kelly or John Corbin Lane, had gone to Ohio in advance of the others to scout out good land. Other citizens of Huntington County [PA] soon joined WIlkinson Lane's group. At about this time, Thomas and Broad Cole Sr. and William and Neal Clark also migrated from Huntington county to Wilkinson's neck of the woods in Fairfield County. It is also thought that Lane's son-in-law, Aaron Cole, accompanied the group.

[6572] Middle Name: From info written by Darleen Ann Ritchey Berens of Huntington beach, CA, on the OHFAIRFI Rootsweb Mailing List, Jan 1998.

DOM/POM: "Genealogical Abstracts from The Lancaster (Ohio) Gazette, V 1, 1826-1873, Fairfield County Gen., Society, March 1998, p 143. Article in 06 Feb 1873 issue, married at the home of Peter HINE of Royalton. Name shown as "Elisha B. LAYMAN".

"Across the street from the Elkhorn, however, stands a house whose occupants are well remembered since they were very active in the Village life. When I first remember it, it was the residence of Jacob Lehman. He was a shoemaker, who came to the Village from Middletown, or Oregon, when the hope of that site growing was given up. He was a public spirited man, as were his boys. Can I recall all their names? There were Andrew, George W., Elisha, Perry and Solomon. There were three daughters. These men were so active in the affairs of the Village that they deserve a chapter for themselves. But we must be content with brief sketches. Andrew was a farmer, and did not live in the Village at any time. George W., of course named in honor of the father of our country, was a blacksmith, and intensely interested in political affairs. About his forge gathered many of those likewise interested.... Perry Lehman was the hardware merchant for his lifetime. He was first a partner of Reuben Blackwood, and then of George Wiser. This firm was as widely known as the Village itself. Elisha and Solomon did not spend all their years in the home village, but were there so frequently as to be considered a part.", "THE VILLAGE.
